Background

The digital services tax, created by the law of July 24, 2019, targets certain revenues of large digital companies, such as targeted advertising and intermediation, at a rate of 3%. During the examination of the 2026 budget, the National Assembly adopted on October 28, 2025 an amendment doubling this rate, by 296 votes to 58. In July 2025, a Senate information report on creation and AI recommended, as a last resort, taxing the revenue of AI players if a presumption of use of cultural content were to fail. This presumption is the subject of a bill adopted by the Senate on April 8, 2026.
