Background
Under French law, copyright protects original works, which the Cour de cassation defines as bearing "the imprint of the personality" of their creator. A Senate information report from July 2025 notes that European and American courts have confirmed that the author must be a human person, which raises the question of content generated with minimal human involvement.
The European regulation on AI requires providers of general-purpose AI models to have a policy for complying with Union copyright law (Article 53). In France, a bill establishing a presumption of use of cultural content by AI providers, tabled in the Senate on December 12, 2025, was adopted there unanimously on April 8, 2026. Transmitted to the National Assembly, it was examined in committee, which tabled its text on June 2, 2026.
